GENERAL TERMS AND CONDITIONS OF BOOKING AND CONTRACTING

1. Identification of the Service Provider

These General Terms and Conditions govern the booking, contracting and participation in the services and activities offered by SPORTS EVASION, S.L., trading as Water Sports Centre, whose registered office and identification details are provided in the Legal Notice of this website.

Booking any activity implies that the customer has read, understood and accepted these Terms and Conditions in full.

2. Scope

These Terms and Conditions govern the booking, contracting and participation in all activities organised by Water Sports Centre, including but not limited to:

  • Jet Ski

  • Parasailing

  • Banana Boat

  • Slider

  • Aquarocket

  • Octopus

  • Kayak

  • Paddle Board

  • Windsurfing

  • Catamaran

  • Sailing

  • Boat Rental

  • Any other nautical activities offered by Water Sports Centre.

3. Booking Procedure

Bookings may be made through the website, by telephone, email or any other booking channel authorised by Water Sports Centre.

A booking shall only be deemed confirmed once the customer has received confirmation from Water Sports Centre.

Water Sports Centre reserves the right to accept or reject any booking request due to lack of availability, pricing or description errors, technical issues, force majeure or any circumstance preventing the proper provision of the service.

4. Payment

The booking may require full or partial payment in advance.

Failure to make payment within the specified period may result in the automatic cancellation of the booking.

Unless otherwise stated, all published prices include the applicable taxes.

5. Participation Requirements

To participate in any activity, participants must:

  • Meet the minimum legal age requirements.

  • Be in suitable physical condition.

  • Not suffer from any illness or condition that could endanger themselves or others.

  • Not be under the influence of alcohol, drugs or medication affecting their physical or mental abilities.

  • Follow all instructions given by Water Sports Centre staff.

Water Sports Centre reserves the right to refuse participation or terminate an activity if it considers that the participant poses a risk to themselves or others.

Participation may also be refused to pregnant persons or to anyone with injuries, medical conditions or physical limitations incompatible with the activity.

6. Minors

Participants under the age of 18 must comply with the applicable legal requirements.

Where required by law, written authorisation from a parent or legal guardian must be provided before the activity begins.

Participants aged 16 or 17 may only operate a jet ski where permitted by law and upon presentation of the required authorisation.

7. Arrival Time

Participants must arrive at least 20 minutes before their scheduled activity.

Late arrival may result in a shorter activity or, where it prevents the normal operation of the service, the loss of the booking without entitlement to a refund.

8. Navigation and Safety Rules

Before the activity begins, all participants will receive a full safety briefing explaining the operation of the equipment, navigation rules and safety procedures.

Participants will be transported from the beach to the navigation area while strictly following the instructor's directions.

During the activity participants must:

  • Follow all instructors' instructions.

  • Remain within the authorised navigation area.

  • Respect all buoys and maritime signs.

  • Maintain a minimum distance of 50 metres from other jet skis, boats and watercraft unless otherwise instructed by the instructor.

  • Properly wear and use all safety equipment provided.

  • Operate the equipment responsibly at all times.

The following are strictly prohibited:

  • Leaving the authorised navigation area.

  • Performing dangerous manoeuvres.

  • Reckless or negligent driving.

  • Intentionally approaching other vessels.

  • Changing the driver without authorisation.

  • Endangering other participants or third parties.

Before starting the activity, participants must ensure that they fully understand the operation of the equipment and all safety instructions. Any questions should be raised with the instructor before departure.

9. Authority of the Instructor

The instructors are responsible for the safety of all participants during the activities.

They may interrupt or immediately terminate the activity or require the immediate return of the equipment whenever they consider that safety is at risk.

They may also withdraw the use of a jet ski or any other equipment where a participant fails to comply with the safety rules or the instructor's directions.

In such cases, no refund shall be granted.

10. Customer Cancellations

Bookings cancelled at least 48 hours before the scheduled activity may be rescheduled subject to availability.

Cancellations made after this deadline, or failure to attend, will result in the loss of any amounts paid.

11. Weather Cancellations

Water Sports Centre may cancel or suspend any activity where weather or sea conditions make it unsafe.

In such cases, and subject to availability, customers may choose between:

  • Rescheduling the activity.

  • Receiving a voucher for the same value.

Where rescheduling is not reasonably possible, Water Sports Centre may refund the amount paid.

The decision regarding the safety and viability of the activity rests solely with Water Sports Centre.

12. Failure to Attend

Failure to attend the activity at the agreed time without prior notice shall be treated as a No Show, and all amounts paid shall be forfeited.

Inability to attend or mistakes made during the booking process shall not constitute valid grounds for a refund.

13. Participant's Responsibility

By participating, the customer declares that:

  • They have read these Terms and Conditions.

  • They have received the safety briefing.

  • They understand the navigation and safety rules.

  • They are physically fit to participate.

  • They participate voluntarily.

Participants shall be responsible for any damage resulting from negligent, reckless or improper use of the equipment.

14. Damage and Repairs

Where damage or breakdown results from negligent, reckless or improper use of the equipment or failure to follow staff instructions, the participant shall be liable for the full cost of repair or replacement.

Water Sports Centre may also recover any losses resulting from the temporary unavailability of the equipment and any other damages permitted by law.

In the event of an accident, participants must provide their personal details and cooperate in completing the corresponding accident report.

15. Insurance

All activities are covered by the liability and accident insurance required under applicable legislation.

Such insurance does not cover damage caused intentionally, through negligence or through failure to comply with staff instructions.

16. Personal Belongings

Water Sports Centre accepts no responsibility for the loss, theft or damage of personal belongings brought by participants, including mobile phones, cameras, glasses, jewellery or any other valuables.

17. Liability of Water Sports Centre

Water Sports Centre shall only be liable where required by applicable law.

It shall not be liable for damages arising from:

  • Failure to comply with safety rules.

  • Negligent conduct by participants.

  • Force majeure or unforeseen circumstances.

  • Adverse weather or sea conditions.

  • Acts or omissions of third parties.

18. Data Protection

Personal data shall be processed in accordance with Regulation (EU) 2016/679 (GDPR), the applicable Spanish data protection legislation and any other relevant legal provisions.

19. Image Rights

Photographs and videos may be taken during the activities for promotional purposes.

Where required by law, the participant's consent will be requested beforehand.

Participants may object to the use of their image at any time in accordance with applicable legislation.

20. Amendments

Water Sports Centre reserves the right to amend these Terms and Conditions where required due to legal, operational or organisational changes.

Such amendments shall not affect bookings already confirmed unless required by law.

21. Governing Law and Jurisdiction

These Terms and Conditions are governed by Spanish law.

Any dispute arising from their interpretation or enforcement shall be subject to the jurisdiction established under the applicable consumer protection legislation.

Where the customer qualifies as a consumer, the competent courts shall be those corresponding to the customer's place of residence whenever required by law.
